Charity Sector Timely Reminders

A couple of reminders about changes happening this month:

Fundraising Code

The new code came into force on 1st November 2025. The new code is designed to be less prescriptive than the previous code and introduces a broader principles-based approach to fund raising matters. In practice this means that there is now a greater burden on Trustees to ensure they have set fund raising policies that address the good governance recommendations within the new code and Charity Commission guidance and which align with the ethos and objectives of their charity. We are recommending that Boards review the changes and consider whether existing policies may need updating.

Ex-Gratia Payments

Remember the Charities Act 2022? Well, the next stage of its implementation is happening on 27th November 2025.  Currently, any ex-gratia payments need Charity Commission consent before they can be paid. From 27th November charities will no longer need this consent for the following individual payments:

Charity’s gross income in the last financial yearMaximum single ex gratia payment
£25,000 or less£1,000
Over £25,000 but not over £250,000£2,500
Over £250,000 but not over £1 million£10,000
Over £1 million£20,000

Individual payments over these threshold limits will still require Charity Commission consent.
